1. Acceptance of Terms
By accessing or using the IrisNote platform you agree to these Terms of Use.
2. Who May Use IrisNote
The service is intended exclusively for licensed healthcare professionals in the United States.
3. Description of Service
IrisNote provides AI-assisted clinical documentation tools designed to help generate structured medical notes from patient encounters and dictation.
4. Medical Disclaimer
IrisNote is not intended to diagnose, treat, or make clinical decisions and should not be relied upon as a substitute for professional medical judgment.
5. Clinical Responsibility and Documentation Review
IrisNote provides AI-assisted documentation tools intended to support healthcare professionals in generating clinical notes. The healthcare professional remains solely responsible for reviewing, editing, and approving all documentation generated by the platform before it becomes part of the patient's medical record. AI-generated documentation may contain errors, omissions, or inaccuracies and must be reviewed by a licensed healthcare professional prior to clinical use.
6. Regulatory and Payer Disclaimer
IrisNote does not guarantee that documentation generated through the platform satisfies the requirements of any payer, regulatory authority, accreditation body, healthcare institution, or billing standard.
7. HIPAA and Business Associate Agreement
The Business Associate Agreement governing the handling of PHI is incorporated into these Terms and becomes effective upon acceptance. IrisNote enters into Business Associate Agreements with healthcare customers where required under HIPAA and requires appropriate contractual safeguards with vendors that may handle PHI.
8. Security
Protected Health Information (PHI) is encrypted in transit and stored within HIPAA-eligible infrastructure located in the United States. Access to systems containing PHI is restricted to authorized personnel and service providers bound by confidentiality obligations and appropriate safeguards.
9. Patient Consent for Recording
Users are responsible for ensuring that any recording of patient encounters complies with applicable federal, state, and local consent laws. IrisNote does not obtain patient consent on behalf of users.
10. AI Model Training
IrisNote does not use identifiable Protected Health Information submitted by users to train artificial intelligence models.
11. Acceptable Use
Misuse of the platform to generate fraudulent medical documentation may violate federal or state law.
12. Limitation of Liability
The service is provided 'as-is.' IrisNote shall not be liable for damages resulting from reliance on AI-generated documentation.
13. Updates to Terms
IrisNote may update these Terms from time to time. Updated Terms will be posted with a revised 'Last Updated' date. Continued use of the platform after updates constitutes acceptance of the revised Terms.
